Oftentimes, attorneys in Maryland find the contributory negligence problem under Maryland law a hurdle too difficult to challenge. I have found that once I have properly screened my cases, that the Doctrine of Contributory Negligence does not bar recovery despite the protests of the insurance companies and of their well-paid lawyers. Because this doctrine still exists in Maryland, however, it takes a determined attorney to know which case to take on and which case to avoid.
